Georgia Personal Injury Statutes of Limitations 

In Georgia, the statute of limitations for most personal injury claims is two years from the date of the injury or accident. This applies to a wide range of cases, including car accidents, slip and fall incidents, dog bites, and product liability cases. However, this two-year limit does not apply to medical malpractice claims, defamation claims, or cases involving loss of consortium. 

If you want to sue someone for damaging your reputation because of false claims, you need to file within a year of the first false claim having been made. Suits for loss consortium must be filed within four years of the date of injury or death. 

It is crucial to file a lawsuit within this two-year period to preserve your right to seek compensation. If you fail to file within this timeframe, you may lose your right to pursue legal action.

Medical Malpractice Statute of Limitations

Medical malpractice claims in Georgia have a more complex statute of limitations:

  1. Standard time limit: Generally, medical malpractice claims must be filed within two years of the date of injury or death resulting from the alleged malpractice.
  2. Discovery rule: In some cases, the injury may not be immediately apparent. Georgia law allows for a limited discovery rule, which states that the two-year period begins when the injury is discovered or should have been discovered with reasonable diligence. 
  3. Foreign object exception: If a foreign object is left in a patient's body during surgery, the patient has one year from the date of discovery to file a lawsuit, regardless of how much time has passed since the surgery.
  4. Minors: For injuries to minors five years of age or older, the statute of limitations is five years from the date of the incident. In cases involving minors under age five, the action can be filed after their tenth birthday (O.C.G.A. § 9-3-73).
